General terms and conditions of sale through thejollyvintners.com, online store of “Veselite Vinari” Ltd.
These general terms and conditions are intended to regulate the relations between “Veselite Vinari” OOD, UIC 200130637, with registered office and address of management: Sofia 1164, 2 “Yakubitsa” Str., Ent. B, hereinafter referred to as the SUPPLIER, and the customers, hereinafter referred to as USERS, on the e-commerce platform of “Veselite Vinari” Ltd., hereinafter referred to as “THEJOLLYVINTNERS.COM”.
These general terms and conditions constitute a contract of sale between THEJOLLYVINTNERS.COM and the USER.
THEJOLLYVINTNERS.COM provides the USER with the opportunity to purchase the goods offered through the online platform by submitting an order and paying the relevant selling price, subject to compliance and compliance by the USER of these General Terms. THEJOLLYVINTNERS.COM reserves the right to change these Terms and Conditions at any time by promptly posting these changes on its website http://thejollyvintners.com, together with a notice of the changes. In case of changes in these General Terms and Conditions, the USER may declare that he rejects the changes by sending a statement rejecting the changes to the e-mail address dimitar@thejollyvintners.com. Upon receipt of the explicit statement of rejection, it is considered that the contract of sale is terminated. The changes in the General Terms and Conditions do not affect the relationship between the USER and THEJOLLYVINTNERS.COM, which arose in connection with a valid application for the purchase of goods submitted before the changes.
I. General
For the purposes of these General Terms and Conditions, the following terms are used with the following meanings:
“VESELITE VINARI” Ltd. is a company registered in the Commercial Register at the Registry Agency, with UIC: 200130637, with registered office and address: Sofia, 2 Yakubitsa Str., Ent. B, offering goods for sale through the online store THEJOLLYVINTNERS.COM
THEJOLLYVINTNERS.COM com is a website for online purchase and sale of goods / items and services provided by “Veselite Vinari” Ltd.
By using THEJOLLYVINTNERS.COM, you declare and warrant that you are at least 18 years old.
“Goods / articles and services provided through THEJOLLYVINTNERS.COM” means:
– wine and spirits within the meaning of the Wine and Spirits Act;
Each of the listed items is described with its main characteristics and selling price.
“USER” means a natural or legal person who has requested and confirmed a purchase from the online platform THEJOLLYVINTNERS.COM. By submitting an order / request, the USER-natural person declares and confirms that he has reached 18 (eighteen) years of age. THEJOLLYVINTNERS.COM reserves the right to refuse an order in case of doubt for 18 (eighteen) years of age by the USER.
II. Orders / purchase orders
Any purchase request from the USER through THEJOLLYVINTNERS.COM on the basis of these General Terms and Conditions is submitted and executed in pursuance of the contract of sale between the parties. In case of a dispute over the will to be bound by the text of these General Terms and Conditions, the person who has paid the price of the goods ordered for purchase shall be considered a party to the contract.
Place an order / purchase request
Order / Purchase request is submitted by the USER and the latter performs the following actions:
The USER determines the type and quantity of the goods and confirms the order (by pressing the virtual button “Make an order” against the respective product);
The USER enters information about the delivery address;
The request for purchase of goods through THEJOLLYVINTNERS.COM is considered made after pressing the “Confirm purchase” button.
In case of incomplete, incorrect or wrong address and / or telephone number when submitting the order / request, it is considered invalid and for THEJOLLYVINTNERS.COM there is no obligation to fulfill it.
Accept the order / request
The purchase order is accepted by THEJOLLYVINTNERS.COM by sending a message to the e-mail address of the USER, with the following content: information about the main characteristics of the ordered product, its selling price, the value of postage or transport costs not included in the sale price and related with its delivery, the method of payment chosen by the USER, the indicated invoice data and delivery address.
The order takes effect between the parties after checking the availability of the goods ordered for purchase and after confirming its validity on the contact telephone number specified by the USER or by sending a message to the e-mail address of the USER.
III. Shipping
The goods ordered for purchase shall be delivered to the delivery address indicated by the USER within the following terms:
– no later than 4 (four) working days – for the territory of Sofia and the country.
In case of inability to fulfill its obligations due to the fact that it does not have the goods ordered for purchase in stock and the inability to deliver by its suppliers, THEJOLLYVINTNERS.COM within 24 (twenty four) hours after receipt of the purchase order , notifies the USER of the exhaustion of the goods by calling the telephone number specified during registration or by sending a message to the e-mail address specified by the USER. THEJOLLYVINTNERS.COM will cancel or change the order at the request of the USER.
The goods are delivered properly packaged, according to its type and transport for delivery.
The goods are handed over to the USER or to a third party, who accepts and confirms the receipt of the same on behalf of the USER by signing the documents accompanying the goods. In case the USER is not found within the delivery time at the address specified by him or access and conditions for delivery of the goods are not provided within that period, THEJOLLYVINTNERS.COM is released from its obligation to deliver the goods ordered for purchase. The USER can confirm his desire to receive the goods after the expiration of the delivery period in which he was not found at the address, bearing all costs of re-delivery. In this case, a new delivery period starts to run from the moment of the confirmation under the previous sentence.
IV. Prices and payment methods
All prices of goods in THEJOLLYVINTNERS.COM online store are in Bulgarian levs, VAT included. Prices do not include delivery costs.
The price and delivery costs may be paid in cash by the USER or by a third party on behalf of the USER at the time of delivery;
В. Rights of the parties
A USER who is a consumer within the meaning of the Consumer Protection Act has the right, without due compensation or penalty and without stating a reason, to withdraw from the contract for the purchase of goods through THEJOLLYVINTNERS.COM, returning the goods within 7 (seven) working days from the date of its receipt. In case the USER withdraws from the contract within the period under the previous sentence, he should send a statement of withdrawal to THEJOLLYVINTNERS.COM and return the goods intact integrity. The statement of refusal should be sent to the e-mail address dimitar@thejollyvintners.com. The USER is obliged to store the goods received from him, to ensure the preservation of its quality and safety.
The right of withdrawal does not apply to the supply of goods which, by their nature, cannot be returned or are subject to rapid deterioration, or there is a risk of deterioration in their quality.
The USER has the right to refuse to receive the goods ordered by him for purchase, when:
– the delivered goods obviously do not correspond to the one ordered by him and this can be established by its ordinary inspection;
– the goods were damaged during transportation.
After receiving the goods, the USER has the right to request its return in case of non-compliance of the goods with the agreed, which could not be established during a simple inspection of the same.
In these cases, the USER may request that the goods delivered to him be replaced with a corresponding purchase order submitted by him by sending a written or oral request to THEJOLLYVINTNERS.COM.
THEJOLLYVINTNERS.COM is obliged to refund to the USER in full the amounts paid by him no later than 15 (fifteen) working days from the date on which the USER has exercised any of his rights of withdrawal.
THEJOLLYVINTNERS.COM is responsible for keeping the information in THEJOLLYVINTNERS.COM up to date.
THEJOLLYVINTNERS.COM does not guarantee that access to the online store will be uninterrupted, timely, secure and error-free, insofar as this is beyond the capabilities, control and will of THEJOLLYVINTNERS.COM. THEJOLLYVINTNERS.COM is not responsible for not providing access to THEJOLLYVINTNERS.COM, as well as for non-processing or untimely processing of purchase orders in the event of circumstances beyond its control – cases of force majeure, accidental events, problems in the global Internet and in the provision of services beyond the control of THEJOLLYVINTNERS.COM.
The provisions of the current legislation of the Republic of Bulgaria shall apply to the issues not settled by these General Terms and Conditions.
These General Terms and Conditions are in force from 01.11.2021.
